Domain Locking Service

1. Service

1.1 The Service provides you with an additional level of security for Applicable Domain Name(s) by restricting the implementation of certain unauthorized or accidental changes at the relevant domain name registry for such Applicable Domain Name(s) unless a strict controlled authentication process has been completed by the Authorized Contact and us.

1.2 For .au Domain(s), the Service can be purchased as either a one (1) month term or two (2) year term service. For gTLD Domain(s), the Service can be purchased only as a one (1) month term service. In both circumstances, the Service term commences at the time of purchase, however the restrictions described in clause 1.1 above will not be implemented until such time as an Authorised Contact and Passphrase have been created by you with us. Unless you otherwise notify us in advance, we will automatically renew the Service for further period(s) equal to the previous term.

1.3 You agree to assist and provide us with the name and contact information of the Authorised Contact and Passphrase in order to provide the Service to you. The Authorised Contact is the sole individual who can activate or deactivate the Service for the Applicable Domain Name(s) and only where our authentication of the Passphrase has occurred.

1.4 Once the Service is activated for any Applicable Domain Name(s), the following changes will be prohibited at the domain name registry level:

  1. for any .au Domain(s):
    1. domain name server record updates;
    2. domain name password updates;
    3. domain name contact changes;
    4. domain name sync; and
    5. changes to the .au extensions via a Registrant correction process; and
    6. deletion requests.
  2. for any gTLD Domain(s):
    1. deletion requests;
    2. inter-registrar transfer requests; and
    3. domain name server record updates.

1.5 We will only process any change updates for any Applicable Domain name(s), upon (i) receiving an update request; (ii) contacting the Authorized Contact (using the phone number the Authorized Contact has provided); and (iii) verbally requesting confirmation of the Passphrase by the Authorized Contact (the Authentication Process). Upon successfully validation of the Authorized Contact and Passphrase (Successful Authentication), we will deactivate the Service and process the change update request, before reactivating the Service. Upon activation or deactivation, the Whois records for the Applicable Domain Name(s) automatically update.

1.6 THE SERVICE WILL NOT PROHIBIT OR PREVENT THE FOLLOWING CHANGE UPDATES:

1.6.1 ANY TRANSFER OF DOMAIN NAME OWNERSHIP (CHANGE OF REGISTRANT);

1.6.2 FOR .AU DOMAIN(S) ONLY, ANY TRANSFER OF DOMAIN NAME BETWEEN REGISTRARS; OR

1.6.3 ANY DOMAIN NAME LIFE CYCLE RELATED CHANGE UPDATES (FOR EXAMPLE, DOMAIN NAME EXPIRY AND SUBSEQUENT NON-RENEWAL PURGES OR DELETIONS BY THE DOMAIN NAME REGISTRY).

1.7 If during the Service the Authorised Contact ceases to be a senior manager, company director or company secretary (or equivalent of these positions) or employee of the Registrant, or if the Passphrase is lost or forgotten, you must immediately notify us and reset the Authorised Contact and Passphrase by resubmitting the applicable form. We won’t be responsible for any loss or damage associated with the Service or the particular domain name the Service applies to where you have failed to comply with these obligations.

1.8 All Service related requests must be made to us directly, and not to any domain name registry.

1.9 The Service can only be purchased for .au Domains and/or gTLD Domains which you are the Registrant of, or which you are authorised by the Registrant to act on behalf of.

2. Cancellation and Suspension

2.1 The Authorised Contact may cancel this Service at any time upon request, subject to the Authentication Process and Successful Authentication occurring.

2.2 We may cancel or suspend this Service at any time, in our sole discretion and without notice to you, in the following circumstances:

2.2.1 the domain name registrant organisation changes;

2.2.2 the Applicable Domain Name(s) transfer to another registrar;

2.2.3 the Applicable Domain Name(s) are cancelled at the relevant domain name registry;

2.2.4 we are directed by a relevant domain name registry or administrator, court order, judgment, determination or other finding of a court or other competent body to make changes to the Applicable Domain Name(s);

2.2.5 in the event either of our supplier(s) temporarily suspend the Service for any reasons.

2.3 We may, in our sole discretion, discontinue this Service upon twenty-five (25) days prior written notice.

2.4 Upon suspension, cancellation or discontinuance of this Service, any registry locks that were activated as part of this Service on the Applicable Domain Name(s) will be unlocked.

3. Your Warranties

You represent and warrant that:

3.1 you are the Registrant of the Applicable Domain Name(s), or you are duly authorised to enter into this agreement on behalf of that Registrant;

3.2 all information you or the Authorised Contact submit to us is accurate, current and complete, and that this information will be kept accurate, current and complete;

3.3 at all times you and the Authorised Contact have the full consent of the Registrant to act on its behalf and any requests in relation to this Service are made with the full knowledge and consent of the Registrant;

3.4 there is no legal obligation which would prevent your submission of the Applicable Domain Name(s) in relation to this Service;

3.5 you agree this Service shall not be used:

3.5.1 for any purpose other than to protect the Applicable Domain Name(s) from inadvertent changes described in clause 1.4;

3.5.2 in a manner which could negatively impact the security and/or stability of the Internet; and

3.6 you are not a party to any agreement which contains provisions that may prohibit the use of this Service.

4. Definitions

“.au Domain(s)” means any registered .au domain names for which Total Solutions IT Pty Ltd trading as Total Solutions IT is the registrar of record.

“Applicable Domain Name(s)” means those .au Domain(s) and/or gTLD Domain(s) you have purchased the Service for.

“Authorised Contact” means a senior manager, company director or company secretary (or equivalent of these positions) of the Registrant who has been nominated by the Registrant and authenticated by us.

“gTLD Domain(s)” means any registered .com, .net, .tv, .cc or .name domain names for which Total Solutions IT Pty Ltd trading as Total Solutions IT is the registrar of record.

“Registrant” means the party identified as the registrant in the public Whois record of the Applicable Domain Name(s)(which can be determined via our Whois tool at https://whois.auda.org.au/).

“Passphrase” means a unique combination of letters and numbers between 6-20 characters with no spaces, as created by the Authorised Contact.
